General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern all contractual relationships between AW SHOP and its customers on the awrah.fr website.

Article 1 — Seller identification

The website awrah.fr (hereinafter referred to as the "Site") is published by:

Article 2 — Purpose and scope

These General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") apply, without restriction or reservation, to all sales concluded between AW SHOP and its customers (hereinafter referred to as the "Customer") carried out on the awrah.fr Site.

Any order placed on the Site implies the Customer's unconditional acceptance of these GTCS in force on the date of the order.

AW SHOP reserves the right to amend these GTCS at any time. The applicable GTCS are those in force on the date of the order.

Article 3 — Products and availability

The products offered for sale are those displayed on the Site on the day of consultation, subject to available stock. Product photographs and descriptions are provided for information purposes only and have no contractual value.

If a product becomes unavailable after an order has been placed, the Customer will be informed by email as soon as possible and may choose between a full refund or an exchange for an equivalent product.

Article 4 — Prices

Product prices are indicated in euros (€), all taxes included (TTC). As AW SHOP benefits from the VAT exemption scheme (art. 293 B of the French Tax Code), VAT is not applicable.

Delivery charges are indicated to the Customer before the order is confirmed, at the time the delivery method is selected.

AW SHOP reserves the right to change its prices at any time. Products will be invoiced on the basis of the rates in force at the time the order is confirmed.

Article 5 — Order

The Customer confirms the order after checking the contents of the basket and accepting these GTCS. The order is final only after payment has been confirmed.

A confirmation email containing the order details will be sent to the email address provided by the Customer.

AW SHOP reserves the right to refuse or cancel any order in the event of a previous dispute with the Customer, suspicion of fraud, or for any other legitimate reason.

Article 6 — Payment

Payment is made online at the time the order is confirmed. The accepted payment methods are:

  • Bank card (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay

Transactions are secured by our payment service provider. AW SHOP does not store any of the Customer's banking data.

Article 7 — Delivery

Products are delivered to the address indicated by the Customer when placing the order. Delivery times and charges are communicated to the Customer before the order is confirmed and may vary depending on the destination and the delivery method chosen.

AW SHOP delivers within mainland France as well as internationally. Specific delivery conditions are detailed in the Shipping Policy.

In the event of a delivery delay, the Customer is invited to contact AW SHOP at contact@awrah.shop. In accordance with article L216-2 of the French Consumer Code, the Customer may terminate the contract if delivery does not take place within a reasonable additional period.

Article 8 — Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the order to exercise the right of withdrawal, without having to provide any reason.

Legal exclusions: In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to sealed products that cannot be returned for hygiene reasons (underwear, undershorts), nor to personalised products.

Article 9 — Legal warranties

All products sold on the Site benefit from the following legal warranties, at no additional cost:

  • Legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code): 2 years from delivery of the goods
  • Warranty against hidden defects (articles 1641 et seq. of the French Civil Code): 2 years from discovery of the defect

Article 10 — Liability

AW SHOP makes every effort to ensure the accuracy of the information on the Site. However, AW SHOP cannot be held liable for errors, omissions, or temporary unavailability of the Site.

AW SHOP shall not be held liable for non-performance or improper performance of the contract due either to the Customer or to an event of force majeure.

Article 11 — Intellectual property

All elements of the Site (texts, photographs, logos, graphics, videos) are the exclusive property of AW SHOP or its partners. Any reproduction, representation, modification, or use in whole or in part is strictly prohibited without prior written authorisation.

Article 12 — Personal data

AW SHOP undertakes to protect its customers' personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Article 13 — Mediation and disputes

In the event of a dispute, the Customer is invited to contact AW SHOP as a matter of priority at contact@awrah.shop in order to seek an amicable solution.

Failing an amicable agreement, in accordance with article L612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge with a view to an amicable resolution of the dispute.

Article 14 — Applicable law

These GTCS are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have exclusive jurisdiction.
